table „Combating torture in the Republic of Moldova”,
Chisinau, May 24-25, 2006
During May 24-25,
2006, the Institute for Penal Reform (IRP), in collaboration
with the Organisation for Securtity and Cooperation
in Europe (OSCE) and the Redress Trust (Seeking Reparation
for Torture Survivors), Great Britain, has organised
in Chisinau a round table „Combating torture
in the Republic of Moldova”. The international
experience in the field of torture prevention was presented
by the international expert Eric Svanidze, former member
of the European Committee for Torture Prevention.
In the wake of the first reported
execution of a child offender in 2006, Amnesty International
expressed its dismay that Iran should be the only country
that currently executes child offenders - those under
the age of 18 at the time of their offence.
Amnesty International
said that the world is in complete agreement that the
execution of a person for a crime committed when they
were under 18 years of age is unacceptable. During
the last decade, the judicial killing of children has
all but stopped. Only a handful of countries now threaten
to carry out such executions and in 2005 Iran was the
only country to do so after it lost its main ally on
this issue: the United States of America.

The ways of applying
the institution of reconciliation, mediation, and declaration
of guilt were discussed at the seminar organised by
the Institute for Penal Reform in cooperation with
the Centre for Scientific Research in Legal Order on
May 19, 2006. An expert from Poland, Krzysztof Pawlowski,
also took part in the seminar and presented the polish
expertise on the application of mediation in criminal
cases.

Recently the Parliament
of the Republic of Moldova has adopted a number of
amendments to the Criminal Code and the Criminal Procedural
Code aimed at improving the system of criminal sanctions
for commitment of certain categories of offences. Thus, the
goal of the amendments and completions to the Criminal
Code is to reduce the general maximum
sentence of imprisonment in case of minors from
15 years to 12 years and 6 months, to extend the legal
framework of applying constraint measures of educational
nature, of the punishment enforcement suspension institution,as
well as to apply punishment by unpaid community
work for a wider range of offences, mostly for
the offences that imply punishment with imprisonment
or fine without an intermediate punishment.
